Mißstände und Fehler in der Maßregeltherapie aus der Sicht des externen Gutachters

Der externe Gutachter, der die Voraussetzungen von Lockerungen und einer bedingten Entlassung eines Patienten aus dem Maßregelvollzug beurteilen soll, muß sich auf die aktuelle Verfassung des Patienten und auf den bisherigen Behandlungsverlauf stützen, wie er insbesondere in den Krankenakten dokumentiert ist. Bei Auswertung dieser Krankenakten finden sich nicht durchgängig, aber häufig Defizite hinsichtlich Therpieplanung, kontrolle und Dokumentation. Dies betrifft insbesondere die Punkte: 1. Vergessen, weswegen der Patient in der Klinik ist: Wegen welcher psychischen Störung, wegen welcher delinquenten Problematik. 2. Fehlen von Knotenpunkten und Einschnitten im Verlauf, Fehlen von definierten Pausen, von Re-Analysen und Ausfahrten aus Sackgassen. 3. Vagheit und/oder Verstiegenheit der Verlaufseinträge und der Stellungnahmen für die Strafvollstreckungskammer; Psychopathologisierung des Alltags; Primat der Deutung gegenüber der Realitätserfassung. 4. Konkurrenz zwischen Lockerungsfragen und therapeutischen Fragen; Konkurrenz zwischen therapeutischer und sichernder Haltung.

Abstract

The external examiner, who is supposed to judge the prerequisites for leniency and conditional release of a patient undergoing the execution of disciplinary measures, has to rely on the immediate disposition of the patient and the previous development of the treatment and especially on the documentation of the offences committed in the sick state. By evaluating these sick deeds one can often, but not consistently, find deficits in the planning, control and documentation of therapy. This is especially pertinent to the following points: 1. The reason for the patient’s internment in the clinic is forgotten: according to which psychic disturbances, according to which delinquent problems. 2. Absence of necessary juncture points and breaks in the course of treatment, absence of definitive pauses, re-analysis and back-tracking out of blind alleys. 3. Vagueness and eccentricity in the written commentaries on the course of development and opinion reports for the board responsable for sentencing and punishment; psychopathologising every day experiences; primacy of meaning given to the comprehension of reality. 4. Rival standpoint in matters of leniency and matters of therapy; opposing priorities between therapeutic measures and maintenance of security.

Résumé

L’expert externe qui doit juger des conditions pour l’octroi des mesures d’assouplissement ou d’une libération conditionnelle d’un malade interné dans une institution médico-légale doit se baser sur l’état actuel du malade et sur le développement du traitement qui est documenté notamment dans les dossiers médicaux du malade. L’exploitation de ces dossiers révèle, non pas en total, mais très souvent, des déficits concernant le plan thérapeutique, le contrôle de la thérapie et la documentation. Cela concerne particulièrement les points suivants: 1. Oubli de la raison pour laquelle le malade est interné, à cause de quel trouble psychique, à cause de quelle problématique délinquante. 2. Manque de noeuds capitons et de tournants pendant le développement, manque de pauses définies, de réanalyses et de sorties des impasses. 3. Position vague et/ou exagérée des inscriptions des développements thérapeutiques et des prises de position pour la chambre d’application des peines; tendance à voir la vie quotidienne sous l’angle psychopathologique; primauté de l’interprétation avant la documentation de la réalité. 4. Concurrence entre questions sur des mesures d’assouplissement et questions thérapeutiques; concurrence entre attitude thérapeutique et sécuritaire
