Die Grenzen der Qualitätssicherung in der Behandlung von Sexualstraftäter in Polen

Der Vortrag behandelt die wichtigsten Probleme, die im Zusammenhang mit der Qualitätssicherung einer Behandlung von Sexualstraftätern in Polen entstehen. Diese Aspekte werden anhand der kasuistischen Beschreibung eines Serienmörders erörtert: Der Fall von Leszek P. zeigt die Unvollkommenheit des Gerichts- und Strafsystems, die begrenzten Möglichkeiten einer Therapie bzw. Resozialisierung dieser Sexualstraftäter und das Abwälzen der Verantwortung für potentielle Gefährlichkeit des Täters auf die psychiatrischen Institutionen.

Abstract

This contribution deals with the most important problems which occur in connection with the degree of guarantee of security and effectiveness of treatment of those committing sexual offences in Poland. By way of a casuistic description of a serial murderer the following aspects will be discussed: The case of Leszek P. shows up the imperfections of the systems of justice and punishment, the limited possibilities of therapy and the resocialising process of this sexual offender and the shifting of the responsibility for a potentially dangerous condition of the criminal onto the psychiatric institution.

Résumé

La contribution traite les problèmes les plus importants qui se posent quant à la garantie de qualité du traitement des délinquants sexuels en Pologne. Ces aspects sont discutés sur la base du cas clinique d’un meurtrier de série: Le cas de Leszek P. démontre l’imperfection du système juridique et pénal, les possibilités restreintes pour la thérapie et la réinsertion de ces délinquants sexuels, ainsi que la délégation de la responsabilité pour la dangerosité potentielle du délinquant aux institutions psychiatriques.
