Assessment of sex offenders in the Netherlands: Linking accountability, penal law and variety in treatment

Das niederländische Strafrechtssystem hat ein Netzwerk forensisch-psychiatrischer Einrichtungen entwickelt, in denen Sexualstraftäter sowohl innerhalb des psychiatrischen Hilfesystems als auch in Institutionen des „T.B.S.“ (im Sinne von: „der Weisung [terbeschikkingstelling] der Regierung unterstellt“) behandelt werden können.

Die Untersuchung und Beurteilung des (möglicherweise) psychisch gestörten Straftäters haben eine Schlüsselfunktion für dieses System, indem sie solche Täter schon zu einem frühen Zeitpunkt, noch vor der Gerichtsverhandlung, identifizieren. Das Gericht kann somit eine spezifische ambulante oder stationäre Behandlung schon in sein Urteil aufnehmen, die dann so schnell wie möglich eingeleitet werden kann.

Um Rückfälle weiter verringern zu können, ist es nun an der Zeit, die laufenden Maß-nahmen in einer umfassenden Studie zu untersuchen und zu bewerten.

Abstract

The Dutch criminal justice system has developed a network of forensic psychiatric provisions in which sexual offenders can be treated both in the mental health system and in institutions within the field of the T.B.S. (detained by the governments pleasure).

The assessment of the (possible) disordered offenders is the key to this system, as it selects these delinquents in an early stage, even before trial. The Court then can recommend certain ambulatory or hospital treatment in its verdict which thus can be arranged as soon as possible.

To continue the reduction of recidivism it is now the moment to evaluate the ongoing provisions in a multicenter study.

Résumé

La législation pénale néerlandaise a développé une couvet ure d’institutions forénésiques et psychiatriques, dans lesquelles il est possible de traiter les délinquants sexuels et dans le cadre des soins psychiatriques et dans les institutions du T.B.S. (<<terbeschikkingstelling>> dans le sens de <<subordonnées au gouvemement>>).

L’examen et le jugement du délinquant sexuel souffrant peut-être d’un trouble psychique sont décisifs pour ce système, parce que de tels délinquants sont déjà identifiés très tôt, même avant la procédure judiciaire.

Ainsi, le jugement du tribunal peut déjà décider sur un traitement spécifique, ambulatoire ou stationnaire, qui peut commencer alors le plus vite que possible.

Afin de continuer à réduire le taux de récidives, il est alors l’heure d’examiner et de juger les mesures en cours dans le cadre des études d’ensemble.
