Legalbewährung nach Entlassung aus dem Maßregelvollzug

Die Effektivität der Forensischen Psychiatrie erweist sich - zumal unter Sicherungsaspekten - nicht vorrangig an den derzeit heftig diskutierten Zwischenfällen im Zuge der Unterbringung, sondern dem Wiedereingliederungsauftrag des Maßregelvollzugs folgend an der Legalbewährung der bedingt entlassenen Patienten. Vor dem Hintergrund der rechtlichen Rahmenbedingungen, insbesondere der Führungsaufsicht, und dem Stand der Rückfallforschung werden Ergebnisse einer nordrhein-westfälischen Studie zur Legalbewährung nach Entlassung aus dem Maßregelvollzug vorgestellt: Sie lassen die Forensische Psychiatrie (zumal im Vergleich zum Strafvollzug) in einem besseren Licht erscheinen, als es die aktuelle Debatte um die Risiken des Maßregelvollzugs für den Schutz der Allgemeinheit vermuten läßt.

Release on Probation after Implementation of Disciplinary Measures

The effectiveness of forensic psychiatry - above all with regard to security matters - does not prove itself foremost by the at present heavily debated matter of incidents occuring during periods of institutional accomodation, but rather through the task of re-integration into society after disciplinary measures have been implemented following probation for patients who have been conditionally released. Against a background framework of legal conditions, particularly the supervision of conduct and research into cases of relapse, the results of a study in Northrhein-Westphalia are presented: It puts forensic psychiatry in a better light (above all in comparison with cases of ‘conventional’ imprisonment) than the contemporary debate would let us believe, concerning the risks involved with the type of detention where therapy plays an important part and the protection of the general population at large.

Résumé

L’efficacité de la psychiatrie forénésique ne se démontre pas primairement - surtout sous des aspects sécuritaires - dans les incidents, à présent vivement discutés, au cours du placement, mais, conformément à la charge de l’internement médico-légal de réintégrer le malade dans la société, dans le délai d’épreuve des malades après leur libération conditionnelle. Sur la base des conditions-cadre juridiques, surtout la probation, et l’état actuel de la recherche de récidive, l’auteur présente les résultats d’une étude, établie en Rhénanie-Westphalie, sur le délai d’épreuve après la libération de l’internement médico-légal. Ces résultats montrent la psychiatrie forénésique (surtout en comparaison avec le régime pénitentiaire) sous un jour plus favorable que la discussion actuelle concernant les risques de l’internement médico-légal le laisse supposer.
