Was ist unter ‘therapeutischen Aspekten’ der forensischen Begutachtung zu verstehen und wie kann der Sachverständige sich auf diese einstellen?

Einleitend werden ‘psychotherapeutische Aspekte’ innerhalb der forensischen Begutachtung inhaltlich präzisiert. Danach wird der gesetzliche Rahmen für die Tätigkeit des Sachverständigen dargestellt. Es folgt eine Übersicht über grundsätzliche und empirische Beiträge zu dem Thema. Schließlich werden in der Diskussion Chancen und Risiken bei der Wahrnehmung therapeutischer Aspekte in der forensischen Begutachtung abgewogen, angesichts des gegebenen Handlungsspielraumes scheinen gesetzliche Neuregelungen nicht unbedingt erforderlich.

What is meant by ‘therapeutic aspects’ within forensic expertising and how can the expert be prepared for them?

Abstract

In the introduction ‘psychotherapeutic aspects’ within forensic expertising are defined with regard to their contents. Subsequently the legal frame of the expert’s profession is presented. After that a review on basic and empirical contributions to the theme follows. Finally in the discussion chances and risks in realizing therapeutic aspects within forensic expertising are balanced considering the existing possibilities. There seems to be no need of legal innovations.

Résumé

Après avoir précisé au début les „aspects psychothérapeutiques“ dans l’expertise pénale quant à leur contenu, les auteurs démontrent le cadre juridique pour la consultation d’un expert. Par la suite, une vue d’ensemble informe sur les contributions fondamentales et empiriques sur ce sujet. La discussion suivante soupèse enfin les chances et les risques lors de la perception des aspects thérapeutiques dans l’expertise pénale. Eu égard à la marge d’action donnée, de nouveaux règlements légaux ne semblent pas forcément être nécessaires.
