Bi-Logic and the Intentionality in Criminal Offences

Es wird vorgeschlagen, daß Handlungen und Unterlassungen einer strafbaren Art, die ent-weder bösartig-gemein oder schuldartig sein können, besser verstanden werden, wenn sie im Licht des psychoanalytischen Begriffs der Bi-Logik, wie von Matte-Blanco postuliert, analysiert werden und auf die Absicht hin, mit der das Delikt begangen wurde, gedeutet wer-den.

Die Diskussion ist gerichtet: auf die symmetrischen und asymmetrischen Denksysteme, ihre Korollaria, auf den Begriff des Verbrechens, seine Implikationen und die Deutung der Schuld durch bi-logische Strukturen.

Abstract

It is put forward that defaulting and actions of a punishable nature, which are either wilfully indecent or of a guilty nature, can be better understood if they can be analysed and interpreted in the light of the psycho-analytic concept of bi-logic, as it is postulated by Matte-Blanco reverting to the intention with which the crime was committed.

The discussion is directed toward the following: symmetrical and asymmetrical thinking systems, their supplements, the concept of crime, its implications and the significance of guilt through bi-logical structures.

Résumé

L’auteur est d’avis que les actions et les négligeances qui sont passibles d’une peine, peuvent être mieux comprises, si elles sont analysées sous l’angle de la notion psychanalytique de la bi-logique, postulée par Matte-Blanco, et si elles sont interprétées tout en considérant l’intention avec laquelle le délit fut commis.

La discussion s’oriente: aux systèmes de pensées symétriques et asymétriques, à leurs corollaires, à la notion du crime, à ses implications et à l’interprétation de la culpabilité par des structures bi-logiques.
