Psychiatrie als Stundenhotel oder Das forensische Subjekt als Zeitwaise Autodafé zur Fragmentierung, Stigmatisierung, Serialisierung im Maßregelvollzug*

Die Arbeit behandelt Fragen der Behandlungszeit und des Behandlungsraums im Maßregelvollzug unter theoretischen wie praktischen Gesichtspunkten. Im ersten Teil wird die Notwendigkeit der Anerkennung von Differenz und reflektierten Ausgestaltung differenzierter Therapieangebote herausgearbeitet. Zugleich läßt sich die Gefahr totalisierender Konzepte mit ihrer Tendenz zur Zerstörung zyklischen Zeiterlebens durch willkürliche Zeitstrukturierungen moderner Arbeitsteilung aufzeigen.

Teil 2 fokussiert die unterschiedlichen Zeitperspektiven von Straftat, Strafprozeß, Psychotherapie und Unterbringung sowie die diskursiven Verhältnisse von Justiz und forensischer Psychiatrie im imaginären Feld von Institution, Ideologie und Wissenschaft. Im dritten Teil stellt der Verfasser die institutionellen Auswirkungen einer bürgerinitiativ erwirkten restrik-tiven Praxis von Lockerungen bzw. Sicherung dar. Er diskutiert die sich aus Stigmatisierung, Entsubjektivierung und Individualisierung ergebenden Konsequenzen für Patientenselbstbild, Behandlungsauftrag, Therapiestandards und Rehabilitationschancen.

Abstract

This contribution deals with the questions of length and scope of treatment within the implementation of disciplinary measures under their theoretical and practical aspects. In part one the necessity of recognition of differentiation and the well thougth out planning of a differentiated range of possibilities of treatment is detailed. At the same time the danger of total concepts with their tendency towards the destruction of the cyclical experiences of time by way of arbitrary separation, which modern working-time structures bring about, can be indicated.

Part two brings into focus the differing perspectives of the offence, the criminal case, psychotherapy and accomodation, as well as the discursive relationship between the administration of the law and forensic psychiatry in the imaginary field of institution - ideology - science. In part three the author presents a factual account of the effects which a citizens’ initiative group had on an institution which brought about restrictive practices in the interest of security. The author discuses the resulting consequences for the self-image of patients, the task of treatment, standards of therapy and the de-subjectivation and individualisation.

Résumé

Cette étude s’occupe - sous des aspects théoriques et pratiques - des questions du temps de traitement et de la place qu’il tient dans les institutions de psychiatrie médico-légale. Dans la première partie, il se manifeste la nécessité de reconnaître la différenciation et de dévelop-per d’une manière réfléchie des offres thérapeutiques bien différenciées. En même temps, il est possible de démontrer le danger émanant des concepts totalisants avec leur tendance de détruire le vécu du temps cyclique par une structuration arbitraire du temps qui est symptomatique pour la division du travail moderne.

La deuxième partie focalise les différentes perspectives temporelles concernant aussi bien le délit, le procès pénal, la psychothérapie et l’internement ainsi que les relations discursives entre la justice et la psychiatrie forénésique dans le domaine imaginaire formé par l’institution, l’idéologie et la science. Dans la troisième partie, l’auteur démontre les effets institutionnels d’une pratique restrictive - obtenue par une association de défence - concernant des assouplissements ou bien l’internement préventif. Il s’occupe de la stigmatisation, de la désubjectivation et de l’individualisation tout en discutant les conséquences qui en résultent pour l’image de soi du malade, pour le mandat de traitement et les standards thérapeutiques et enfin pour les possibilités de réhabiliter les malades.
