Approval Model versus Objection Model – Legal Aspects of Organ Transplantations

The article analyses the approval model common in Germany and demonstrates that there are better arguments in favour of the objection model. Organ donations among living persons should be admissible if they are in accordance with the will of a person capable to understand and sufficiently informed after having been medically warned and consulted. Besides there should be a regulated system of compensation that would lead to a medically reasonnable exchange of organs for compensation.
